Description

Job Purpose or Objective

The Office of Public Defender is responsible for defending all indigent clients in felony,misdemeanor, and traffic cases that are punishable by incarceration in the ChoctawNation of Oklahoma District Court.

New Primary Tasks

  • Manage caseloads, which includes interviewing and advising clients of theirlegal rights and obligations. Interviewing witnesses and potential witnesses,including police officers and expert witnesses.

  • Prepare cases, appear in Tribal Court, and represent clients charged with Tribaloffenses at Tribal Court hearing, preliminary hearings, bench trials, and jurytrials.

  • Argue special actions and appeals.

  • Recommend additional legislation necessary to upgrade the Office of PublicDefender or to improve the Choctaw Nation of Oklahoma justice system.

  • Review assignment of indigency status to identify clients who have availableresources, collecting costs of representation when feasible.

  • Perform all other duties as assigned pursuant to the Choctaw Nation ofOklahoma law.

Minimum Requirements

  • Juris Doctorate from accredited law school

  • Licensed to practice law by a State within the United States

  • Experience with criminal, juvenile, and/or deprived case procedures.

  • Application of professional knowledge and ability by possessing strongjudgment and evaluation skills

  • Jury trial experience in felony, misdemeanor and/or deprived custody cases

  • Willingness to understand, learn and appreciate Choctaw culture and traditionand cultural differences of clients;

  • Four years of criminal defense experience in state, federal, and/or tribal court

Target Requirements

  • Juris Doctorate from accredited law school

  • Licensed to practice law by a State within the United States

  • Knowledge of federal Indian law, the Indian Civil Rights Act, and the IndianChild Welfare Act.

  • Experience as public defender and/or working with indigent clients.

  • Jury trial experience in felony, misdemeanor and/or delinquent or deprivedcases

  • Willingness to understand, learn and appreciate Choctaw culture and traditionand cultural differences of clients;

  • Five years of criminal defense experience in state, federal, and/or tribal court
